The Order as ordered by you specifies you have entered into Purchase Agreement with us.

16. Payments

Most major credit cards accepted by phone, fax, or email. Payment can be made by business cheque, in person, direct debit, bank deposit and bank transfer.

If a payment is due on a day that is not a business day, the payment must be made on the preceding business day unless it is a payment on demand, in which case the payment must be made on the next business day.

Payment by Phone or by email: On receipt of your request, an invoice will be E-mailed &/or Faxed to you which you can print off, an original also can be posted for payment if required. Payments must be made within 7 days. Payments must be made prior to Ambiance Interiors shipping your ordered goods & services.

Complaints & handling: In the unlikely event that you should need to complain about our services, please email the management team directly: management@ambianceinteriors.com.au

We will personally reply to any contact within 5 working days to resolve the complaint. Firstly to acknowledge your issue by reply e-mail. Then by phone to resolve the complaint. We will keep you informed throughout the process on developments. You can also call customer service on (+612)96987522, 9am-5pm Monday / Friday.

17. Pricing

Prices displayed are in AUD and they are indicative of our Sydney metropolitan prices. Prices may vary from state to state and they may be subject to change without notice if necessary. Where applicable, prices also exclude GST. Delivery or Freight charges are not included in the price structure.

18. Indemnities

You indemnify us against any claim by any person and any costs, charges, expenses, loss or damage suffered or incurred by us arising from:

(a) the products or its use; and
(b) any failure to comply with your obligations under these terms & conditions

19. COSTS, CHARGES AND EXPENSES

You irrevocably agree to pay or reimburse us on demand for all costs, charges and expenses incurred or to be incurred directly or indirectly at any time by us, our authorised officers or agents entering into the agreement including but not limited to costs, charges and expenses in preparing, negotiating or executing the agreement, defending any claim or interest of any nature whatsoever in the products which we may regard as being adverse to our interest in or title to the equipment or products or doing or attempting to do anything whatsoever in connection with the agreement that we are entitled to do under the terms of the agreement including and without any limitation whatsoever, solicitor and other legal costs on a solicitor and client basis or a full indemnity basis, whichever is the higher.

20. PRIVACY AND CREDIT INFORMATION - PRIVACY ACT AUTHORISATION

Acknowledgment of Disclosure of Credit Information to Credit Reporting Agency
You acknowledge that the Privacy Act allows Ambiance Interiors Pty Ltd (Supplier & credit provider) to give a credit reporting agency certain personal information about your consumer, or commercial credit worthiness from a credit reporting agency for the purpose of assessing your application orders or collecting any overdue payments. By virtue of this acknowledgment you understand that the above named credit provider has informed you of its disclosure to a credit-reporting agency of information about you and you so authorise such disclosures.

Authority for Credit Provider to Perform Certain Permitted Actions Concerning an Application to trade with Ambiance Interiors Pty Ltd &/or Assessment

You agree that, if it is considered relevant in assessing my/our application for personal or commercial credit, or as a guarantor of credit, the above named credit provider may obtain respectively a report on your commercial worthiness or a report on your personal credit worthiness from a credit reporting agency. You agree that, if it is considered relevant to collecting your overdue commercial credit payments, the above named credit provider “Ambiance Interiors Pty Ltd” may receive a credit report concerning your personal or commercial credit arrangements and credit worthiness, as permitted under the Privacy Act.

21. Overdue Payments

If any amount payable to us is not paid on its due date, you agree to pay to us:

(a) a late service charge equal to 5% of each late payment; and
(b) interest on late payment of 3% per month calculated daily from the due date of such late payment until the date paid and
(c) any overdue payment that has not been negotiated by Ambiance Interiors before the due date and placed on a payment plan; will be automatically referred to a credit collection agency and
(d) All legal proceedings, credit agency costs, all associated fees/charges and litigation proceedings costs will be incurred by you and deemed payable by you the default customer.

22. Dishonoured Cheque Fee

You agree to reimburse the above named Credit Provider $20.00 for any cheque that is dishonoured due to insufficient funds in your account during the period of this arrangement.

23. Government Charges

You agree to contracted amounts to be revised in the event of changes to any statuary government charges and/or GST.

24. Taxes

You indemnify us for all taxes (including sales tax if applicable) payable on or in relation to the payments made under your order & invoice.

25. Online requests:

You will receive a reply by e-mail, fax or post and will be contacted by one of our consultants within 48 hrs, upon completion of the transaction.

26. E-mails

You will receive promotional e-mails from us, you will be given the opportunity to "opt-out" or stop receiving them.
If you choose to "opt-out," we will stop sending you e-mails. Please note, however, that some e-mail promotions are prepared well in advance, so you may continue to receive offers after you have chosen to "opt-out." We appreciate your patience in giving us time to carry out your request.

27. Consignments, Loan, Rentals & Hire Terms and Conditions (Applies to All customers)

CARE OF OR LOSS OR DESTRUCTION OF GOODS

The Renter(s) shall keep the said goods in good order and condition, fair wear and tear expected, at all times during the renting and upon their return to AMBIANCE INTERIORS and the Renter(s) indemnifies AMBIANCE INTERIORS for any damage to the goods. In the event of the Renter(s) failing to return the rental goods to AMBIANCE INTERIORS at the termination of the renting or in the event of the said goods being lost and/or destroyed from any cause whatsoever then the Renter(s) shall be liable to pay AMBIANCE INTERIORS the value of the said goods such value not to exceed the retail price of the said goods at the commencement of the renting.

CHANGE OF ADDRESS

The Renter(s) shall not move or allow to be moved the goods from the place of delivery or installation herein without the permission in writing of AMBIANCE INTERIORS but such permission shall not unreasonably be withheld.

RIGHT OF ACCESS AND POSSESSION

The Renter(s) acknowledges AMBIANCE INTERIORS’ title to the rental goods and AMBIANCE INTERIORS’ right to the immediate possession hereof upon termination of the renting or the Renter(s) failing to comply with any of the conditions herein contained and the Renter(s) acknowledges and agrees that AMBIANCE INTERIORS, its employees and agents for the purposes of exercising such right to immediate possession shall have the right, using any reasonable force, to enter upon any premises where the goods are then reasonably expected to be, following AMBIANCE INTERIORS first having served notice in writing to the Renter(s) at least 24 hours prior to such entry. The Renter(s) shall and hereby does indemnify and hold harmless AMBIANCE INTERIORS from and against any liability, loss, costs, charge or expenses arising either directly out of the exercise of such right of possession and/or right to enter.

PARTIAL WAIVER

AMBIANCE INTERIORS agrees that upon receipt of the rental payment on or prior to the due date as prescribed, the Renter(s) will be relieved of any liability hereunder for loss of or damage to the rented goods caused by explosion, accidental discharge of water from plumbing or heating system, acts of God or any other unavoidable casualty such as a natural disaster, provided however, that the Renter(s) shall not be relieved of any liability for larceny, malicious, destructive or negligent acts committed by the Renter(s) or any other person admitted to the location of the rented goods with the acquiescence or permission of the Renter(s). This provision shall be effective only if (1) the rental owing moneys are not in arrears (2) the Renter(s) orally informs AMBIANCE INTERIORS within forty-eight hours of the time of discovery thereof and (3) the Renter(s) within seven days following such oral notification send written confirmation accompanied by full details to AMBIANCE INTERIORS of such event.

RETURN OF GOODS BEFORE INTIAL RENTAL PERIOD

The initial rental rate shown is conditional upon the goods being rented for the whole rental period selected ("the initial period"). However, if the Renter(s) wishes to return the goods before the end of the initial period, the Renter(s) may do so PROVIDED:

(1) The Renter(s) pays to AMBIANCE INTERIORS an amount equal to The Agreed initial rental rate OR the amount otherwise payable for the remainder of the initial period, whichever is the lesser; and (2) Such return is at the Renter(s)’ sole expense and the goods are returned in good order and condition.

CLEANING FEE.

If the rented goods are returned unclean an appropriate cleaning fee will be applicable.

MALFUNCTION OF APPLIANCE

AMBIANCE INTERIORS agrees to repair or replace any electrically operated appliance on rental herein which has a malfunction within three days of the Renter(s) notifying AMBIANCE INTERIORS in writing of the malfunction and should such repair or replacement be not carried out within three days the Renter(s) shall not be liable for rental of that appliance for such period in excess of three days until such appliance is repaired or replaced. The Renter(s) indemnify AMBIANCE INTERIORS against any claim for loss (including business loss) or expense for damage due to malfunction or breakdown of the goods.

REFUND OF DEPOSIT

AMBIANCE INTERIORS agrees to refund the security deposit, dond or checks as specified upon (1) receipt of the goods by AMBIANCE INTERIORS and (2) payment of all monies payable to AMBIANCE INTERIORS by the Renter(s) in accordance with the conditions herein contained. The cost of returning the rental goods shall be at the expense of the Renter(s). Should the Renter(s) require AMBIANCE INTERIORS to collect the goods the Renter(s) agrees to three days notice of such requirement.

OVERDUE PAYMENTS

The Renter(s) agrees to pay all rental payments or moneys owing in advance without further notice from AMBIANCE INTERIORS. Where the Renter(s) have provided to AMBIANCE INTERIORS credit card and/or bank account details the Renter(s) hereby authorizes AMBIANCE INTERIORS to automatically debit such credit cards and/or bank accounts to pay the overdue payments and all incidental costs. The Renter(s) further agrees to pay the costs of all notices, demands and proceedings which AMBIANCE INTERIORS deems necessary to obtain such payments.

GOVERNMENT VALUE ADDED TAX

AMBIANCE INTERIORS reserves the right to vary the rental payments at any time to reflect the introduction of, or change in the rate of any Government Value Added Tax, Consumption Tax or similar, but only to the extent that such tax is levied to AMBIANCE INTERIORS. If the rental payments are increased for any other reason the Renter(s) may terminate the renting by returning goods in good condition (fair wear and tear excepted) and paying all rental and any other monies due up to the date of delivery of the goods to AMBIANCE INTERIORS or AMBIANCE INTERIORS agents.

NOTICE OF DISCLOSURE

Of the Renter(s) credit information and agreement that AMBIANCE INTERIORS may seek commercial or personal credit information. Under section 18 (E) (8) (c) of the privacy act 1988 (Cth) AMBIANCE INTERIORS is allowed to give a credit reporting agency personal information about the Renter(s) credit application. The information which may be given to an agency is covered by Section 18 (E) (1) of the privacy act and includes: (a) The Renter(s) particulars; (b) The fact the Renter(s) has applied for credit and the amount; (c) The fact that AMBIANCE INTERIORS is a current credit provider to the Renter(s); (d) Details of any payment which have become overdue by more than 60 days, and for which collection action has commenced; (e) Advice that payments are no longer overdue; (f) Details of any cheques drawn by the Renter(s) which have been presented and dishonoured more than once; (g) The fact that credit provided to the Renter(s) by AMBIANCE INTERIORS has been paid or otherwise discharged; and (h) In specific circumstances, that in the opinion of AMBIANCE INTERIORS the Renter(s) has committed a serious credit infringement. If AMBIANCE INTERIORS considers it relevant to assess the Renter(s) application for personal or commercial credit or any subsequent application by the Renter(s) for further personal or commercial credit then the Renter(s) hereby agrees to AMBIANCE INTERIORS obtaining a report or any further reports from time to time, about the Renter(s) commercial activities or commercial credit worthiness and/or the Renter(s) personal credit information from a credit reporting agency and/or business which provides information about the commercial credit worthiness of persons.

28. General

AMBIANCE INTERIORS administers this Site from its offices in Sydney, Australia. AMBIANCE INTERIORS makes no representation that materials or services at this Site are appropriate or available for use outside Australia, and access to it from territories where their contents are illegal is prohibited. You may not use or export or re-export the materials or services at this Site or any copy or adaptation in violation of any applicable laws or regulations including without limitation Australian & U.S. export laws and regulations. If you choose to access this Site from outside Australia, you do so on your own initiative and are responsible for compliance with applicable local laws. These Terms will be governed by and construed in accordance with the laws of the State of New South Wales, without giving effect to any principles of conflicts of laws.
